Who we are
Kipple is made and operated by [YOUR LEGAL NAME OR TRADING NAME], of [YOUR ADDRESS] (“we”, “us”). Contact us at vvmoore213@gmail.com.
By downloading or using Kipple you agree to these terms. If you do not agree to them, please do not use the app.
Going outside, carefully
Kipple asks you to go and photograph things. Please read this part properly.
You are responsible for your own safety and for obeying the law. Nothing in Kipple is an instruction to go anywhere in particular. Look where you are going. Mind the traffic. Do not climb, trespass, enter private land or restricted places, ignore signage, or put yourself or anybody else at risk in order to photograph something.
Do not photograph people without their consent, do not photograph children who are not your own, and do not use Kipple anywhere that photography is prohibited.
If you are supervising a child using Kipple, that supervision is yours to provide.
We are not responsible for what happens while you are out with your phone. Use common sense, and treat a prompt as a joke rather than a dare.
Your licence to use Kipple
We give you a personal, non-exclusive, non-transferable licence to use Kipple on devices you own or control, for your own non-commercial use, in line with Apple’s App Store terms.
You agree not to copy, reverse engineer, resell or redistribute the app, its artwork or its prompts, and not to use it in any way that breaks the law or interferes with the service.
Your photographs
Photographs you take stay yours. We claim no ownership of them.
You grant us only the narrow permission needed to run the feature you asked for: to transmit and process an image in order to identify what is in it and return a result. This permission ends as soon as that result is returned. See the privacy policy for exactly where images go.
You confirm that you have the right to photograph what you photograph.
Stickers and artwork
The sticker artwork, prompts, theme names and everything else supplied with Kipple belong to us. You may use the sticker packs personally, including sending them in messaging apps. You may not sell them, print them for sale, or pass them off as your own.
Paying for Kipple
Kipple is free to download. It includes a free daily prompt and a limited number of additional scans each day. Kipple Everything removes the daily limit and unlocks every theme.
Forever is a single payment. It does not renew.
A year is a subscription that renews annually until you cancel it. Where a free trial is offered, the subscription begins and payment is taken when the trial ends, unless you cancel before then.
All payments are taken by Apple through your Apple Account. Prices are shown in the app in your own currency before you buy. You can manage or cancel a subscription in the App Store at any time, including during a free trial. Cancelling stops the next renewal; it does not refund the current period.
Refunds are handled by Apple under their policies, not by us. If something has gone wrong, write to us anyway and we will help where we can.
Changes to the app
Kipple will change. We may add, alter or remove themes, prompts and features, and we may stop offering the app entirely. If we withdraw a paid feature you have already bought outright, we will give reasonable notice and act fairly about it.
Identification is a best effort
Kipple uses an automated system to guess what you photographed and whether it answers a prompt. It will sometimes be wrong, occasionally comically so. Nothing it tells you is a statement of fact about the world, and it should not be relied on for anything that matters.
Liability
Kipple is provided as it is, without warranty that it will be uninterrupted, error free or fit for any particular purpose.
To the extent the law allows, we are not liable for indirect or consequential loss, loss of data, or loss arising from your use of the app or from anything you did while out using it. Where we are liable, our total liability is limited to the amount you paid us for Kipple in the twelve months before the claim.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.
Ending it
You can stop using Kipple at any time by deleting it. We may suspend access if the app is being misused in a way that harms the service or other people.
Governing law
These terms are governed by the laws of [YOUR JURISDICTION, e.g. England and Wales], and disputes will be handled by its courts. If you are a consumer resident elsewhere, you keep the protection of any mandatory laws of your own country.
Apple
Apple is not a party to these terms and has no obligation to provide support for Kipple. Apple is a third-party beneficiary of these terms and may enforce them against you.
